Terms of service

These terms govern your use of Apera, operated by Erik Majlath ("we", "us"). By creating an account or using the service, you agree to them.
The service
Apera turns text you want to read into a personal vocabulary and helps you learn it through spaced-repetition cards, short generated stories, and pronunciation audio.
Your account
You must provide a valid email and keep your credentials secure. You are responsible for activity under your account. You must be at least 16 to use Apera.
Acceptable use
Use Apera lawfully. Do not upload content you have no right to use, attempt to disrupt or reverse-engineer the service, abuse or circumvent usage limits, or use it to infringe others' rights.
Your content
You keep all rights to the text and images you add. You grant us a limited licence to store and process them solely to provide the service to you — extracting vocabulary and generating study material. We do not claim ownership, do not use your content to advertise, and do not share it except with the service providers described in our privacy policy.
Your responsibilities for what you upload
You are responsible for the text and images you add. By adding them, you confirm that you own them or otherwise have the right to use them, and that doing so does not infringe anyone else's rights or break any law. Apera is for your own learning. Do not upload material you are not permitted to copy, and do not add anyone else's personal information.
Reporting infringement
If you believe content on Apera infringes your rights, email [email protected] with enough detail to identify the content and your rights in it, and we will review and act on valid notices. We may remove content and may suspend or end the accounts of users who infringe repeatedly.
Generated content
Stories, explanations, and audio are produced by automated language and speech models and may contain errors. They are study aids, not authoritative translations or references.
You may use the study material we generate for you for your own learning. We do not use your uploaded content, or the text we derive from it, to train our own or third-party models.
Payments
Apera is free to use. We will update these terms before introducing any paid plans.
Availability
Apera is provided "as is". We do not guarantee it will be uninterrupted or error-free, do not guarantee any particular learning outcome, and may change or discontinue features.
Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential losses arising from your use of the service. Nothing in these terms limits liability that cannot be limited under applicable consumer law.
Indemnity
You agree to cover reasonable losses we incur from third-party claims arising out of content you uploaded in breach of these terms or of someone else's rights.
Suspension and termination
You may stop using Apera and request deletion at any time. We may suspend or end access for breach of these terms.
General
We are not responsible for delays or failures caused by events beyond our reasonable control. If any part of these terms is found unenforceable, the rest still applies. These terms, together with the privacy policy, are the whole agreement between us about Apera. We may transfer our rights and obligations under these terms — for example, if our business is reorganised or acquired — and your rights are not affected.
Changes
We may update these terms; we will change the date above and, for material changes, notify you.
Governing law and disputes
These terms are governed by the laws of the Czech Republic. Nothing here removes your right, as a consumer, to bring proceedings in your country of residence or to rely on mandatory protections of your local law.
